Pro Funding Options underwrites and provides funding solutions directly. From time to time, we may reference or link to outside resources (such as educational articles, calculators, or governmental guidance) for informational purposes only. Those external resources are not operated by or affiliated with our funding programs, and their inclusion does not constitute an endorsement. You should always perform your own due diligence before relying on information from any third-party website or service. Pro Funding Options is not responsible or liable for the content, completeness, or accuracy of information provided by unaffiliated third parties.

User Consent to Communication

By submitting your contact information through any Pro Funding Options form or tool, you expressly consent to receive follow-up communications from Pro Funding Options, including our employees and authorized agents, regarding your funding inquiry. Opting Out of Pro Funding Options Communications:

You may opt out of receiving marketing emails from Pro Funding Options at any time by clicking the unsubscribe link in any email, or opt out of receiving marketing text messages by following the opt-out instructions provided (such as replying "STOP" to a text). You may also contact us directly at info@profundingoptions.com to be placed on our internal Do Not Contact list for email, phone, and/or text communications. Once we process your opt-out request, Pro Funding Options will refrain from sending you further promotional communications.

Communications Sent via Service Providers:

Dispute Resolution & Arbitration

Binding Arbitration:

You and Pro Funding Options agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of our website or services (including any question regarding the existence, validity, or termination of these Terms) shall be resolved through binding arbitration rather than in court, except that either party may assert claims in small claims court if they qualify. The arbitration will be administered by JAMS (or a similar reputable arbitration organization) pursuant to its Comprehensive Arbitration Rules and Procedures. The arbitration will take place in a mutually agreed location, before a single neutral arbitrator.

Choice of Law:

The arbitrator shall apply applicable U.S. and state law to the merits of any dispute, consistent with the Governing Law clause above.

Arbitration Fees:

Each party shall be responsible for their own attorneys' fees, and any filing or administrative fees will be governed by JAMS rules (subject to any ability for you to seek a fee waiver under applicable law).

Waiver of Jury Trial:

To the extent any dispute is determined by a court rather than an arbitrator (for example, if this arbitration agreement is found unenforceable), you knowingly and voluntarily waive any right to a trial by jury in any such legal proceeding.

Exceptions:

This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies; such agencies can, if the law allows, seek relief against us on your behalf. Also, either party may seek emergency injunctive relief in a court of law in order to maintain the status quo pending the arbitrator's decision, and this provision shall not require arbitration of disputes that by law cannot be subject to a pre-dispute arbitration agreement.

Opt-Out:

You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to our contact address below within 30 days of first accepting these Terms. If you opt out, you will not be bound by the arbitration provision, but all other parts of these Terms will continue to apply. Opting out of arbitration has no effect on any previous or future arbitration agreements you may have with us.

Severability

If any provision of these Terms is held to be invalid or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms or agreements that apply to specific services you use (all of which are incorporated herein by reference), constitute the entire agreement between you and Pro Funding Options regarding your use of the site and services. They supersede any prior or contemporaneous agreements, communications, and proposals (whether oral or written) between you and us regarding the same subject matter. No amendment to these Terms will be valid unless made in writing and signed by Pro Funding Options.
